Meta’s $375m Verdict Is Not a Tech Story.

It’s a liability story, and insurance hasn’t caught up yet.

Last week, a New Mexico jury ordered Meta to pay US$375 million after finding it misled the public about the safety of Facebook and Instagram for children, in breach of state consumer protection laws. The jury accepted that Meta had internal knowledge of harm, received warnings from employees, and failed to act while continuing to represent its platforms as safe. 

Meta has said it will appeal. That almost doesn’t matter. 

Because the real signal isn’t about Meta. 

It’s about how courts are now treating product design, platform behaviour, and known risk; and what that means for liability and insurance. 

This Ruling Changes The Risk Equation

What makes this case so significant is how liability was established. 

The verdict did not rely on new regulations, futuristic AI law, or bespoke tech statutes. It relied on a simple and familiar legal idea: 

If you know your product causes harm, and you misrepresent that risk, you can be liable - at scale. 

In parallel cases in California, juries have also found Meta and YouTube negligent for harms linked to social‑media addiction, reinforcing a broader trend: 

algorithms, engagement mechanics, and safety controls are now being treated as part of the “product”. 

Those reframing matters. Because once something is treated as a product, it sits squarely inside the liability ecosystem. 

The Uncomfortable Truth For Boards

This case exposes three assumptions many organisations still quietly rely on: 

1. “We disclosed enough.” 

Generic disclosures, complexity arguments, or references to “ongoing challenges” were not enough. The jury focused on the gap between internal knowledge and external reassurance. 

2. “This is regulatory risk, not insurable risk.” 

This was a civil damages verdict, not a regulatory fine. It landed directly in the territory traditionally covered by D&O, product liability, and general liability - areas many programs were never designed for at this scale. 

3. “This is a US big‑tech problem.” 

The legal theory where misleading conduct and known harm, maps uncomfortably well to Australian Consumer Law, class action regimes, and global plaintiff strategies. 

If you operate a platform, marketplace, data‑driven product, algorithmic decision engine, or embedded technology, this is no longer a theoretical risk. It’s a transferable one. 

The Real Insurance Gap This Exposes

From an insurance perspective, the Meta verdict shines a harsh light on a growing blind spot: 

  • D&O insurance 

Claims framed around misrepresentation of safety, risk governance, or failure of oversight place real pressure on Side C and entity cover. Insurers are already tightening language in response. 

  • Product & General Liability 

Courts are increasingly willing to treat digital experiences and algorithmic behaviour as “products”. Many policies were priced for physical goods, not behavioural harm on a global scale. 

  • Cyber insurance 

These cases are not data breaches, yet cyber governance failures sit at the centre. Expect sharper exclusions where harm is not “pure cyber”. 

  • Aggregation risk 

The real exposure isn’t a single claim. It’s stacking liability across multiple policies from the same underlying conduct. 

This is not a failure of insurance. 

It’s a mismatch between how risk has evolved and how programs are still structured. 

What Better‑Prepared Organisations Are Doing Now

The companies most resilient to this shift are not panicking. They are being precise. 

They are: 

  • Re‑defining “product risk” 

Explicitly treating algorithms, UX design, and safety controls as insurable exposures - not abstract tech issues. 

  • Aligning representations with reality 

Pressure‑testing marketing claims, investor disclosures, and public statements against what is actually known internally. 

  • Designing insurance towers intentionally 

Structuring D&O, Cyber, and Liability programs to respond coherently to a single‑event, multi‑theory claim rather than hoping one policy “picks it up”.

If a court treated your product, platform, or data model as the thing that caused harm tomorrow: 

  • Which policy responds first? 
  • Where does the loss aggregate? 
  • And what would your insurer argue that doesn’t apply? 

If the answer isn’t immediately clear, that uncertainty itself is the risk.
